Terms of Service
These terms are the agreement between you and qhost for using qhost.dev, the dashboard, the API, the CLI and everything we run for you. Please read them; by creating an account you accept them.
1. The service
qhost builds and runs your applications, databases, workers, scheduled jobs and storage buckets on servers we operate, and gives you domains, private networking, logs and metrics to manage them. Features may change as the product evolves; when we remove something you rely on, we give reasonable notice.
2. Accounts
- You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract.
- Give us accurate information and keep it current. One person or organization per account; don't create accounts to get around plans, limits or a suspension.
- You are responsible for everything done with your account, its API and project tokens, and by the members you invite to your workspaces. Keep credentials secret, turn on two-factor authentication, and tell us right away at [email protected] if you suspect someone else has access.
3. Plans and billing
- Paid plans are billed monthly in advance through our payment processor, Stripe. Each plan includes the same amount of usage credit as its price; usage beyond it (CPU, memory, storage and network, as shown in the dashboard) is charged on the next invoice.
- Trials, when offered, require a valid payment method and convert to the chosen plan when they end unless you cancel first.
- Prices exclude taxes, which are added where required. We give at least 30 days' notice before raising the price of a plan you are on.
- If a payment fails and is not resolved, the workspace is suspended: its services stop and nothing new can be deployed. Data of a suspended workspace is kept for 30 days and then permanently deleted. We email you before that happens.
- You can cancel at any time; the plan stays active until the end of the paid period. Except where the law requires otherwise, payments are not refundable, including for workspaces suspended for breaking these terms.
4. Your content
- Your code, data, files, environment variables and anything else you deploy or store ("your content") remain yours. You give us only the permission we need to host, build, run, copy, back up and display it in order to provide the service.
- You are responsible for your content, for having the rights to it, and for how your applications treat the data of your own users, including complying with the privacy laws that apply to you.
- Keep your own backups of anything important. We back up the platform and offer database backups as a feature, but we cannot guarantee that data will never be lost.
- We look at your content only to run the service, to keep it secure, to investigate abuse, when you ask us to (for example in a support request), or when the law requires it.
5. Acceptable use
You must follow the Acceptable Use Policy, which is part of these terms. In short: no cryptocurrency mining, spam, attacks, malware, phishing, illegal content, open proxies or attempts to get around the platform's isolation and limits. We detect some of these automatically and may stop services or suspend workspaces that break the policy.
6. Availability and support
We work to keep qhost fast and available and publish its current state at status.qhost.dev. We don't promise uninterrupted service: maintenance, failures of hardware, networks or providers, and events outside our control can cause downtime. Planned maintenance that affects running services is announced on the status page in advance whenever possible. Support is provided by email on a best-effort basis unless your plan says otherwise.
7. Suspension and termination
- You can stop using qhost and delete your projects or account at any time from the dashboard.
- We may suspend or terminate an account or workspace, with notice when practical, if it breaks these terms or the Acceptable Use Policy, if payment fails, if it puts the platform or other customers at risk, or if the law requires it. For serious abuse, such as mining or attacks, we may act immediately.
- After termination your content is deleted as described in the Privacy Policy. Sections that by their nature should survive (payment owed, liability, disputes) continue to apply.
8. Warranties and liability
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, qhost is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
You agree to defend and indemnify qhost against claims arising from your content or from your use of the service in breach of these terms.
9. Changes to these terms
We may update these terms. The date at the top shows the current version; for significant changes we email account owners at least 15 days before they take effect. Continuing to use qhost after that means you accept the new terms.
10. Governing law and contact
These terms are governed by the laws of Brazil, without regard to conflict-of-law rules, and consumers keep any protections the law of their country gives them. Questions about these terms: [email protected].
